Terms of Service

1. Acceptance

By downloading, installing or using Zephyr (the application or the cloud sync service), you agree to these Terms of Service. If you do not agree, please do not use Zephyr.

2. License of the application

The Zephyr desktop application is free and open source software, released under the GNU General Public License version 3.0 (GPL-3.0). The full text of the license is available in the LICENSE file of the source repository at github.com/Prismo-Studio/Zephyr.

You may use, study, modify and redistribute the application under the terms of that license. The cloud sync backend is operated separately and is provided as a service, not as redistributable software.

3. Cloud sync service

Cloud sync is an optional feature offered free of charge. To use it, you must authenticate with a valid Discord account. By signing in, you agree to the collection and processing of data described in our Privacy Policy.

3.1 Acceptable use

You agree not to:

• Upload content that infringes the rights of third parties
• Use the service to distribute malware or malicious mods
• Attempt to gain unauthorized access to other users' profiles
• Abuse the service through automated requests, scraping or excessive load
• Reverse engineer or interfere with the backend infrastructure

3.2 Account termination

We reserve the right to suspend or terminate any account that violates these terms, without prior notice in case of serious abuse. You can stop using the service at any time by signing out and asking for the deletion of your data.

3.3 Service availability

The cloud sync service is provided on a best effort basis. We do not guarantee uptime, performance or data preservation. Scheduled maintenance and unexpected outages may temporarily prevent access. You are responsible for keeping local backups of any profile you consider important.

4. User content

You retain full ownership of the mod profiles you upload to the cloud. By uploading them, you grant Prismo Studios the limited right to store, process and serve those profiles solely for the purpose of providing the sync service to you and to friends with whom you explicitly share a profile.

The mods themselves remain the property of their respective authors and are governed by their own licenses on Thunderstore, CurseForge or their original distribution channels. Zephyr does not own, rehost or redistribute mod binaries through the cloud sync service. Profile archives only contain a list of mod references and your local configuration files.

5. Disclaimers

Zephyr is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement.

Mod installation can break your game, your save files or your system configuration. You install and use mods at your own risk. Prismo Studios is not affiliated with the publishers of the games you mod and is not responsible for any consequence on your game accounts, including bans on online services.

6. Limitation of liability

To the maximum extent permitted by applicable law, Prismo Studios shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data, use, goodwill or other intangible losses, resulting from your use of or inability to use Zephyr or the cloud sync service.

7. Modifications to the service and to these terms

We may update these Terms of Service from time to time. The date at the top of this page reflects the latest update. Continued use of Zephyr after a change constitutes acceptance of the new terms. Significant changes will be announced on our Discord server and in release notes.

8. Governing law

These terms are governed by French law. Any dispute arising from these terms will be submitted to the competent courts of France, unless mandatory consumer protection rules give you the right to bring action before another court.
